These Terms of Sale ("Terms") govern the purchase of SuperFind licenses from Guido Pardini, sole proprietor (P.IVA 02644510469, flat-rate tax regime, "regime forfettario"), Via Giovanni Duprè 46, 50131 Florence (FI), Italy, trading as Oibo ("we," "us," "Seller"). They apply together with our End User License Agreement (EULA) and Privacy Policy.
1. Product
SuperFind is a plugin for Adobe Illustrator, licensed under the terms of our EULA. What is included is described on our website at the time of purchase.
2. Prices
Current prices are shown on our Pricing page and confirmed at checkout, in the currency displayed there. Prices include any VAT or sales tax applicable in your country: the amount shown is the amount you pay. Taxes are calculated, collected and remitted by LemonSqueezy as Merchant of Record, as described below.
3. Seller of Record and Payment
All purchases are processed by LemonSqueezy, Inc., which acts as Merchant of Record: LemonSqueezy is the reseller of the license, handles payment processing, tax collection and remittance where applicable, invoicing, and customer payment data, under its own terms and privacy policy. Your contract for the purchase transaction itself is with LemonSqueezy as Merchant of Record; your license to use the Software is granted directly by us under the EULA.
4. Order Process
Clicking "Buy" starts the LemonSqueezy checkout. Monthly and Annual plans are subscriptions that renew automatically; the recurring nature, billing frequency and price are shown at checkout before you confirm. The contract is concluded once payment is confirmed. You will receive your License Key by email, generated automatically, with no manual delivery step and no shipping. See Section 5 for how renewal and cancellation work.
The free 5-day Trial uses the same LemonSqueezy checkout at a price of zero: no payment card is requested, and a Trial License Key is emailed to you. The Trial does not renew, involves no payment, and is not a purchase for the purposes of these Terms; it is governed by the EULA.
5. Subscription, Automatic Renewal and Cancellation
Monthly and Annual plans are subscriptions. You receive a renewal reminder by email 7 days before each renewal date. At the end of each billing period, LemonSqueezy automatically charges your payment method the then-current price for your plan and your license period is renewed, unless you have canceled beforehand. You can cancel at any time, at no cost, through the customer portal provided by LemonSqueezy; a link is included in your purchase confirmation and renewal emails. Canceling stops future renewals only: it does not refund or shorten the period you have already paid for, and your license stays usable until that period ends.
If a renewal charge fails, LemonSqueezy automatically retries it up to four times over the following two weeks; during this time your subscription shows as past due, but your license stays active and you are notified by email each time so you can update your payment details. If every retry fails, the subscription becomes unpaid, your license expires, and LemonSqueezy continues sending you recovery emails with a link to update your payment details and reactivate.
6. Right of Withdrawal (EU Consumers)
If you are a consumer resident in the EU, you have a statutory right to withdraw from this purchase within 14 days without giving any reason. This right applies to your initial subscription purchase; it does not restart at each automatic renewal, since a renewal continues the same subscription rather than forming a new contract. To end the subscription going forward at any time, use the cancellation process in Section 5 instead.
However, SuperFind is delivered as a digital product with immediate access upon payment, and offers a separate 5-day free Trial for you to evaluate it beforehand. Where our checkout presents a box for this, checking it to confirm you wish to begin using the Software immediately means you expressly acknowledge and agree that you lose your right of withdrawal as soon as performance begins, that is, as soon as your License Key is issued and usable. Where no such box is shown, activating your License Key has the same effect, since doing so is itself your clear request for immediate performance. In practice, since your purchase already follows a free Trial and delivers your License Key instantly, the withdrawal period ends at the moment you activate it for most customers.
If you do not activate your License Key, you may still exercise your right of withdrawal within 14 days by writing to customer.oibo@gmail.com.
7. Refunds
Other than the statutory right of withdrawal above (only where it has not been waived), we do not offer refunds, including for the unused portion of a billing period after cancellation. Because the Software can be evaluated in full for free for 5 days before any purchase, and canceling always stops future charges going forward, we consider this a reasonable and clearly disclosed policy. This does not affect any right you may have if the Software is defective and not as described, under mandatory consumer protection law, or LemonSqueezy's own discretion, as Merchant of Record, to issue a refund on our behalf within 60 days of purchase, including to prevent a payment dispute. If you believe you are owed a refund, contact us first at customer.oibo@gmail.com.
8. Complaints and Support
For any issue with your purchase, license, or the Software, contact customer.oibo@gmail.com. We aim to respond within 2 business days.
9. Governing Law and Jurisdiction
These Terms are governed by Italian law. Disputes are subject to the exclusive jurisdiction of the Court of Florence, Italy, without prejudice to any mandatory consumer protection rights under the law of your country of residence if you qualify as an EU consumer, including the right to use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
10. Changes
We may update these Terms; the version in force at the time of your purchase applies to that purchase.
